The offer and the sale of the products on our web site “www.cottonclubboutique.it” are governed by the following General Sale Conditions.

THE PARTIES:

Client: it is the person who purchases products in this web site: “cottonclubboutique.it”.

For Client we mean a person who acts on “cottonclubboutique.it” with purposes not concerning own business, professional or commercial activity.

The seller reserve the right not to satisfy orders coming from subjects different by the definition of client reported above.

SUBJECT OF THE CONTRACT:

It is the on-line sale of the products published on the pages of the site “cottonclubboutique.it”, in accordance with the modalities and conditions reported in this General Sale Conditions. Cotton club S.r.l. reserves the right to modify in anytime the description of the products, as well as the General Sale Conditions published on this site. The contracts regularly settled before the modification of the General Sale Conditions will be valid with the previous terms and conditions.

SETTLEMENT OF THE CONTRACT:

The client can purchase on the web site “cottonclubboutique.it” after registering. To settle a purchase contract of one or more products on “cottonclubboutique.it”, you will have to fill the on-line order form and transmits it to the seller following the instructions. The on line purchase procedure, generates immediately the activation of a purchase proposal from the client.
The General Sale Conditions are considered accepted with the sending of the proposal’s order. The sale Contract is settled between the parties at the moment that the consumer receive the order’s confirm.

PRODUCTS AVIABILITY:

The typology of the products published in the “cottonclubboutique” and their aviability will able to be changed in anytime without any responsibility for Cotton Club s.r.l towards the clients.

The Indication regarding the aviability of the products is not binding. In case of following unavailability of a product, indicated as available at the moment of the forwarding of the order from client, Cotton Club s.r.l. undertakes to inform the client in a following communication by email the approx date for the new availability.

The Client can withdraw the order by 48 hours from the receiving of this communication from Cotton Club S.r.l. sending a communication by email to the address helpdesk@cottonclub.it . In this Case Cotton Club S.r.l. undertakes to refund the price the soonest possible.

PRODUCTS:

The Cotton Club S.r.l. seeks to present and to allow the visibility and the colors in the most true and accurate manner possible. The show of colors depend by the monitor used by the client and Cotton Club Sr.l. cannot guarantee that your monitor represents the colors in the correct manner.

PRICE AND SHIPPING COSTS; TAXES AND DUTIES:

The price is expressed in € (eur). The price applied is that you find in “cottonclubboutique.it” at the moment of the forwarding of orders by the Clients.
The VAT tax is included (20 %) at the moment of order’s summary and in case the products are shipped from Cotton Club S.r.l. and delivered inside the European Union. In case the products are shipped by Cotton Club S.r.l. and delivered outside the European Union, the price has to be considered VAT excluded.
The price doesn’t include the shipping costs. Cotton Club S.r.l. intends to ask for the clients a contribution for the shipping costs that it can depend by the delivery service requested, quantities of products, volume, weight and destination.
The contribution requested by Cotton Club S.r.l. for shipping costs is indicated , separately from the price, before the confirmation of the order by the Clients together and contextually at the payment.

Further taxes, duties or other expenses provide for the country where the products are shipped and delivered will be entirely at charge of the clients and paid at the delivery, directly customs or fiscal authorities or at the courier in charge for the delivery.

PAYMENT METHOD:

The client makes the payment of the Price and the contribution for the shipping costs through credit card . In the moment that you will decide to settle trough credit card, “cottonclubboutique.it” will forward automatically to a secure site (SSL) of the “ Consorzio Triveneto Gruppo MPS” which works with.
In this site you will fill your credit card data with the max security and guarantee as the information is directly transferred to the bank , and anybody, even Cotton Club s.r.l. can get to know your codes. The debt of your credit card will be made at the moment of the shipping of your products.
Together with the shipping of the ordered products, Cotton Club S.r.l. send an invoice to your email. The invoice will be issued using the personal information provided by the client when registered.

SHIPPING:

The shipping of the order will be made by an International express courier

The shipping costs, defined at the moment of the purchase, change according the type of delivery and country of destination.

As soon as your order will be picked up by the International courier, we will send you an email with the tracking number of your shipping. In case the international courier doesn’t find anybody at the address indicated, it will repeat the delivery for three (3) times, after that it will directly contact you .In any case our client service will contact you as well in the shortest time possible.

WITHDRAWAL RIGHT:

In case our clients are “consumers” (For Consumer we mean a person who acts on “cottonclubboutique.it” with purposes not concerning own business, professional or commercial activity) has the right, in accordance with the. 64 del D. Lgs. n. 206/2005, to withdraw from the Sale Contract by 10 days from the date of receiving the products purchased. The right of withdrawal has to be exercised by the client sending to Cotton Club S.r.l. a written comunication by email addressed to helpdesk@cottonclub.it , containing:

1. The will to use the withdrawal right;
2. The order reference indicated in the sale contract from which intend use the withdrawal right.

In case of use by Our Client the right of withdrawal described in this section:
a. Our client binds to return the Products by 5 days from the withdrawal communication;
b. all the cost connected with return of products are entirely at the client charge;
c. Cotton Club S.r.l. binds to refund the price within 30 days from the date of the written withdrawal communication, on condition that:
- The products are returned and are intact;
- The original packaging of the products has to be returned as well and it has to be intact;
- The products have not to be used;
In case the clients use the withdrawal right not in conformity with the formalities and terms of the present section, the clients has not the right to get the refund of the price.

The refund will be made only on the credit card used for settling the order and the necessary period to display the amount depends by the financial company which issued the credit card.

RIGHTS OF THE INTELLECTUAL PROPRIERTY

The Brands, the commercial names, the copyright, the design, the patent and the other rights of the intellectual proprierty incorpored and used in relation of the products are and will be of exclusive propriety of the seller.

PRIVACY POLICY:

Cotton Club S.r.l. informs that some information got by you will be necessary for the order fulfillment, invoicing, shipping. In any case we kindly ask you the read our privacy policy.

ENFORCEABLE LAW:

The General Sale Conditions and the sale Contract are regulated by the Italian Law.

For any arising dispute regarding the interpretation of the General Sale conditions or the Sale contract shall fall within the cognizance either of the Fabriano or Ancona Court.
